Why ABC Reporters were arrested, but not Najib?

This article is a link from the previous article. Since the 1MDB corruption scandal of the current Prime Minister (PM) in Malaysia-Najib has been reported by Wall Street Journal (WSJ), a few countries have started investigating on it, including Singapore, USA, Hong Kong, Britain, France, and Switzerland. As he has involved into the money laundering case at 1MDB, he could be arrested by Interpol if he travels overseas.

However, the president of 1MDB, Arul Kanda, told the BBC reporter that no foreign investigators were investigating their employees and the investment fund. How could he not know that 1MDB is under investigation?

In fact, international news agencies have also talked about the issue of Najib.

So, Najib’s scandal is not an unrated news. It is a serious case in which has terrified and threatened the democracy of Malaysia. To me, it is more than that. It is also a video to seek the external power from foreign countries to step down his Dark Side Power because no one can arrest him in Malaysia. Therefore, it is possible for Australia and other foreign countries to exert pressure on Najib to quit being a PM. He is not qualified to be a leader of Malaysia to lead Malaysians.

The Reason Of Why Najib Is Not Arrested Yet.

After we understand the corruption case, it was already confirmed that Najib will be arrested by Interpol if he leaves Malaysia, but why Malaysia Anti-Corruption Commission (MACC) did not arrest and prosecute Najib? What is the obstacle to prevent them from doing something to him?

According to the law of Malaysia, the Attorney General (AG) is the one who has the power to prosecute. Ironically, the job of MACC is to collect evidence, draft accusation sheets and submit them to the AG. On December 31st, 2015, MACC had submitted two reports to the AG about the issue of USD$700 million dollars in Najib bank account. They also emphasised that the investigation is still ongoing. Suddenly, on January 26th, 2016, the AG, Apandi Ali, declared that Najib has no sin as the $700 million dollars in his personal bank account was transferred by a Saudi Royal Family as a donation.

Why do they want to donate money to Najib? (The part one article has already identified that it is not for donation, is for business investment.)

It is the point to suspect the answer which is made by the AG. I do not consider that he is not the one who is suitable to make a decision in this case, as he was appointed by PM. According to the Constitution of Malaysia, the Prime Minister (PM) may recommend a judge of Federal Court to the Yang-di-Pertuan-Agung, also known as the King of Malaysia, for approval as the AG for the federation. However, he was appointed to be the AG to replace the previous AG, Abdul Gani Patail, when the previous AG was investigating him that time. It is difficult to determine whether he was selected with a rational or biased decision. It seems like the Attorney General was covering up for Najib, although there is no evidence to prove it. Therefore, it is not a proper way to let PM select whom to be the AG.

Through questioning the progress of appointing AG, it is also the critical point to view the loophole of the government system. There is no one can examine the AG whether he would make a just or biased decision of prosecution. In this sense, I would consider that it is possible for MACC to have the authority to prosecute. I understand why MACC does not have the right to prosecute. To achieve the obligation of check and balance, the body of anti-corruption agencies only have the right to investigating and preventing the case of corruption; the right of prosecution is separated from the body of anti-corruption agencies. Let’s see an example in Australia , the Independent Commission Against Corruption (ICAC) in New South Wales also has no right to prosecute; they can only give the law suggestion to the Director of Public Prosecutions to charge individuals who have committed crimes.

But the condition of Malaysia is different, there are four main reasons to comprehend why MACC should have the right of prosecution.

  1. The police and political parties are corrupted. Bribe-paying is a common way for Malaysians to obtain services from them. A corrupted system of police and political parties is impossible for Malaysians to believe that they could bring justice to the country.
  2. The new AG was appointed by PM, Najib. No one can confirm that his statement is clear and fair. Also, how close is the relationship between them? No one knows about it.
  3. There are many foreign investigators involved in the investigation. Even, Interpol is ready to arrest the PM.
  4. They had arrested Australia’s ABC Four Corners Investigators as they were investigating the Najib’s corruption in Malaysia. From this issue, we can understand that the media freedom has limited and restricted by the government authority.

Hence, how could Malaysians continue to believe in the system of police and political parties? I would say that the trust of PM and the government system have been collapsed, it is difficult to rebuild the trust of them by their public relations. The only way to see the hope of Malaysia is to allow MACC to have the right to prosecute and fight the corruption. If not, there is no one who has the right to prosecute him.

I believe that the documentary video, State of Fear: Murder and Money in Malaysia, is an effective way to spread the issue of Najib corruption over the world, and also encourage international political leaders or NGO to do something to him as he has a tremendous power to protect himself in Malaysia. It does not matter how small things we can do for Malaysia, but we can gather all of the small things together to become a big thing for them, to fight for a better tomorrow. This is the journey of democracy; the blood of democracy; the hope of Malaysia.
