Once more, Americans question if justice system leaders respect power limits while the public doubts their trustworthiness, based on key decisions made by General Mark Milley and President Joe Biden during important times in U.S. leadership. So, when and why these decisions were made, what message they send to the public, and how they affect Americans’ confidence in their legal system?

General Milley: A Shield or a Threat to Civilian Authority?

As the election campaign of Donald Trump drew to a close in his first term, General Mark Milley, the Chairman of the Joint Chiefs of Staff, did drastic things to avoid any possibility of misuse of the military. On January 8, 2021, Milley briefed his top brass on the proper procedures to guard the use of nuclear weapons yet again. He also made calls to his Chinese counterpart, General Li Zuocheng, to assure him that the United States had no intention of launching an attack. (Jacobs, 2025)
