In the aftermath of the Supreme Court’s decision to end race-based affirmative action in college admissions, the nation’s elite colleges have found themselves under intense scrutiny. Debates about legacy admissions and other practices have sparked discussions on equality and fairness, but amidst the clamor for change, one essential aspect seems to be overlooked — these institutions are private.

Just like any private business or organization in the United States, elite colleges operate with complete autonomy. While some universities fall under federal regulations due to accepting federal funding, the elite colleges with substantial endowments, such as Harvard, can easily rely on other revenue streams and choose independence over government funding. These institutions raise their operational funding without depending significantly on taxpayer support, setting them apart from state public universities.

While the pursuit of equality and fairness in admissions is undeniably crucial, we must remember that private colleges and universities have the freedom to shape their admission policies as they see fit. They have the liberty to prioritize certain criteria, including legacy and other factors, in their admissions process. Just as we respect the autonomy of private businesses to manage their affairs, we should extend the same courtesy to these educational institutions.

Some argue that more legislation and laws should govern private colleges, but we should carefully consider the consequences of such actions. Stricter regulations could compromise the unique identities and characteristics that have made these institutions globally renowned centers of learning. Preserving their independence allows them to maintain their educational philosophies and foster innovative learning environments.

However, this is not to say that the discussion around admissions practices should be silenced. Open dialogue and thoughtful exploration of admissions policies are essential for progress. Elite colleges should continue to engage in self-reflection and consider whether their practices align with their core values and the changing needs of society.

As advocates of equality, we can encourage colleges to implement policies that promote diversity, equity, and inclusion without compromising their autonomy. Rather than imposing rigid regulations, we can foster a collaborative approach where private institutions voluntarily strive to adopt fair admissions practices that reflect the values of a diverse and inclusive society.
