Collateral arrests/detentions were challenged in a 2022 class-action settlement. The Castañon Nava Settlement To Protect Immigrant Communities (Nava) implemented stricter parameters, including new restrictions on warrantless arrests. Under Nava, ICE agents are required to uphold strict guidelines to make warrantless arrests. Among those requirements is to establish the immigrant in question will attempt to flee ahead of court proceedings.

Regardless of Nava requirements, the Trump regime told us directly that collateral arrests were “part of a strategy for enforcement” in sanctuary cities.
