Chile joins the TrademarkVision revolution
In October 2017, Chile joined the TrademarkVision revolution and became the first South American country to integrate image recognition and artificial intelligence in their examination process. This innovative move allows INAPI examiners to improve the quality of their examinations, using our visual search technology for their trademark applications.
Finding relevant trademarks that include a figurative element is one of the most time-consuming stages of the examination process. To analyse thousands of results with no order of priority, is an arduous task and simply a waste of resources. As well as being tedious, it also creates higher risk of error which can be detrimental to the success of an examination.
“About 50% of trademark applications contain figurative marks so image search is important to us. As the quality of substantial examination is improved, so will the predictability of INAPI’s decisions.” said Carolina Belmar, Deputy Manager of the Department of Trademarks, Geographical Indications and Appellations of Origin at the National Institute of Industrial Property.
With image searching, examiners are empowered in the decision-making process and armed with substantial evidence to build their cases.
“The results are available in seconds and the most relevant ones are placed at the beginning of the list. This has an enormous impact in the quality of trademark examination, as we are no longer partially blind when it comes to figurative signs and can now base a refusal decision on a solid reason, not only due to the fact they have the same Vienne codes but due to the comparison of the images themselves.” Belmar said
