As a licensed cannabis retailer in the state of Washington, there are minimum requirements that must be met to be considered fully operational. After the issuance of a cannabis retail license, the licensee has up to nine months to be a fully operational cannabis retail business that is open to the public. Per WAC 314–55–055, fully operational means the business meets the required criteria for at least 12 consecutive weeks within a 12-month period which includes:

  • Is open to the public for a minimum of five hours a day between the hours of 8 a.m. and 12 midnight, three days a week;
  • Posts business hours outside of the premise in the public view; and
  • Reports monthly sales from the sale of cannabis products and pays applicable taxes.

There are exceptions to the fully operational requirements, such as not being able to open due to local jurisdiction permitting, zoning, or bans. If you have any questions about license forfeiture or how to define fully operational, please contact Ashley Staaleson at ashley.staaleson@lcb.wa.gov.
