Packaging and Labeling of Cannabis-Infused Edibles in Compliance with Department of Health

Substitute House Bill 1453 provides a temporary tax exemption from the 37% cannabis excise tax for qualifying patients and designated providers with a recognition card on purchases of cannabis products that are labeled Department of Health (Health) compliant under 246–70 WAC.

A licensed cannabis processor may add the appropriate logo (above) to a previously approved cannabis-infused product package without getting further packaging approval from LCB if the existing approved packaging already contains:

  • The mandatory FDA statement, warning symbols and
  • Serving sizes per Health-compliant product standards

Any prior label approvals for cannabis-infused edibles that do not contain both of these must get LCB approval for a new label before adding the DOH-compliant product logo. Due to potential for increased submissions, the turnaround time for approvals may take a bit longer than it typically does.

Cannabis retailers may not update existing packaging to reflect any status change of a cannabis product that has been re-tested to medically compliant product standards.
